Pro Plan
Advanced features require a paid Pro subscription:
- Pro is billed monthly ($9/month) or annually ($79/year), processed securely by Stripe, Inc.
- All prices are in U.S. dollars. Sales tax may apply based on your location as required by law.
- Payment is charged at the time of subscription and recurs automatically at the end of each billing cycle until you cancel.

- If we change the subscription price, we will notify you by email at least 30 days before the new price takes effect. If you do not cancel before the new price applies, you will be charged the updated amount.
Refund Policy

- If you believe you were charged in error, contact support@firetrajectory.com within 14 days of the charge.
- If your Pro subscription lapses, your data is retained but Pro features become inaccessible until you resubscribe.

10 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIRE TRAJECTORY AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO:

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
11 Indemnification
You agree to defend, indemnify, and hold harmless Fire Trajectory and its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your use of or access to the Service.

12 Dispute Resolution & Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Informal Resolution First
For any dispute, controversy, or claim arising out of or relating to these Terms or the Service (“Dispute”), you and Fire Trajectory agree to first attempt to resolve the Dispute informally by contacting us at legal@firetrajectory.com. We will attempt to resolve the Dispute within 30 days.
Binding Arbitration
If the Dispute is not resolved informally, you and Fire Trajectory agree to resolve it through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, available at www.adr.org.
- Arbitration will be conducted in English, in the state of Maine or remotely by videoconference at the claimant’s election.
- The arbitrator’s decision will be final and binding, and judgment may be entered in any court with jurisdiction.
- The arbitrator may award the same relief that a court could award, including injunctive and declaratory relief.
Costs
- For claims under $10,000, Fire Trajectory will pay all AAA filing and arbitrator fees. You are responsible only for your own attorneys’ fees unless the arbitrator awards them to you.
- For claims over $10,000, the AAA Consumer Arbitration Rules govern fee allocation.
- If the arbitrator finds your claim to be frivolous (as defined by Federal Rule of Civil Procedure 11(b)), you agree to reimburse Fire Trajectory for all fees.
Exceptions to Arbitration
- Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to preserve the status quo pending arbitration.
- Either party may bring claims in small claims court (or equivalent) if the claim qualifies, in the county where you reside.
Opt-Out
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@firetrajectory.com with the subject line “Arbitration Opt-Out,” your name, and the email associated with your account. If you opt out, disputes will be resolved in court under Section 13.
13 Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict-of-law principles.
For any Disputes not subject to arbitration (including claims for injunctive relief or qualifying small claims), you and Fire Trajectory consent to the exclusive personal jurisdiction of the state and federal courts located in Cumberland County, Maine.
United States only. The Service is intended solely for use by residents of the United States. By using Fire Trajectory, you represent that you are a U.S. resident. Users outside the United States use the Service at their own risk and are solely responsible for compliance with any local laws that may apply.
14 Force Majeure
Fire Trajectory shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government actions, sanctions, embargoes, internet or infrastructure outages, cyberattacks, power failures, or failures of third-party service providers (including Supabase, Netlify, Stripe, or AWS).
In such circumstances, our obligations will be suspended for the duration of the event, and we will use commercially reasonable efforts to resume operations.
15 Termination
By You
You may delete your account at any time through your account settings. Upon deletion, all your personal data will be permanently removed within 30 days. If you have an active Pro subscription, cancellation of the subscription is separate from account deletion — please cancel your subscription first to avoid further charges.
By Us
We reserve the right to suspend or terminate your access to the Service at any time if:
- You violate these Terms or our Acceptable Use policy.
- You engage in fraudulent, abusive, or illegal activity.
- We are required to do so by law or court order.
- We discontinue the Service (with at least 30 days’ notice to active users).
We will make reasonable efforts to notify you prior to termination unless the violation is severe or we are legally prohibited from doing so.
Effect of Termination
Upon termination, all licenses and rights granted to you under these Terms immediately cease. The following Sections survive termination: 6 (Your Data), 7 (Intellectual Property), 9 (Disclaimer), 10 (Limitation of Liability), 11 (Indemnification), 12 (Dispute Resolution), 13 (Governing Law), and 17 (General Provisions).
16 Changes to These Terms
We may revise these Terms from time to time. When we make material changes, we will:
- Notify registered users via email at least 30 days before the changes take effect.
- Update the “Last updated” and “Effective date” at the top of this page.
- Post a prominent notice within the Service.
For non-material changes (formatting, clarifications), the updated Terms are effective immediately upon posting. Continued use after the effective date constitutes acceptance.
If you do not agree to revised Terms, you must stop using the Service and may delete your account.
17 General Provisions
- Entire Agreement — These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fire Trajectory regarding the Service, superseding any prior agreements.
- Severability — If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force.
