2 Description of Service

Fire Trajectory is a personal finance planning tool designed to help individuals track their path to Financial Independence and Early Retirement (FIRE). The Service includes features such as:

IMPORTANT — NOT FINANCIAL ADVICE: Fire Trajectory is for informational and educational purposes only and does not constitute financial, investment, tax, or legal advice. All projections, calculations, and estimates are hypothetical, based on the data you provide and simplified mathematical models. They may not reflect actual results. Past performance and mathematical projections do not guarantee future results. Fire Trajectory is not a registered investment adviser, broker-dealer, financial planner, or tax professional. Always consult a qualified, licensed financial professional before making any financial decisions.

3 Eligibility & Account Registration

To use the Service, you must be at least 16 years of age (or the minimum age required in your jurisdiction). By creating an account, you represent and warrant that you meet this requirement.

By registering, you agree to:

You are solely responsible for all activity under your account, whether or not authorized by you.

9 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, OR NON-INFRINGEMENT.

We do not warrant that:

Fire Trajectory is not a registered investment adviser, broker-dealer, certified financial planner, CPA, or tax professional. The Service does not provide personalized financial advice. You use the Service and rely on its outputs entirely at your own risk.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FIRE TRAJECTORY AND ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO:

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

11 Indemnification

You agree to defend, indemnify, and hold harmless Fire Trajectory and its owners, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

Exceptions to Arbitration

Opt-Out

You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing legal@firetrajectory.com with the subject line “Arbitration Opt-Out,” your name, and the email associated with your account. If you opt out, disputes will be resolved in court under Section 13.

CLASS ACTION WAIVER: YOU AND FIRE TRAJECTORY AGREE THAT EACH MAY ONLY BRING CLAIMS AGAINST THE OTHER IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not preside over any class or representative proceeding. If this waiver is found unenforceable, the entire arbitration agreement shall be void (but the rest of these Terms shall remain in effect).

13 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict-of-law principles.

For any Disputes not subject to arbitration (including claims for injunctive relief or qualifying small claims), you and Fire Trajectory consent to the exclusive personal jurisdiction of the state and federal courts located in Cumberland County, Maine.

United States only. The Service is intended solely for use by residents of the United States. By using Fire Trajectory, you represent that you are a U.S. resident. Users outside the United States use the Service at their own risk and are solely responsible for compliance with any local laws that may apply.

14 Force Majeure

Fire Trajectory shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, civil unrest, government actions, sanctions, embargoes, internet or infrastructure outages, cyberattacks, power failures, or failures of third-party service providers (including Supabase, Netlify, Stripe, or AWS).

In such circumstances, our obligations will be suspended for the duration of the event, and we will use commercially reasonable efforts to resume operations.

15 Termination

By You

You may delete your account at any time through your account settings. Upon deletion, all your personal data will be permanently removed within 30 days. If you have an active Pro subscription, cancellation of the subscription is separate from account deletion — please cancel your subscription first to avoid further charges.

By Us

We reserve the right to suspend or terminate your access to the Service at any time if:

We will make reasonable efforts to notify you prior to termination unless the violation is severe or we are legally prohibited from doing so.
